In an order which led to the adoption of Local Exchange Carrier (“LEC”) Rule 31 (see Goldin at Para. 52, supra), the Court reversed a Commission order requiring telephone corporations to summarily discontinue service to subscribers when advised by any law enforcement agency that the service was being used for unlawful purposes. The Court concluded that the procedure by which telephone service was terminated on such a basis must include submission of the claim of unlawfulness to a magistrate for a determination of probable cause.
