The Court reversed a Commission decision determining that unclaimed refunds payable to Pacific Telephone & Telegraph Company should be distributed pro rata to Pacific’s current customers. The Court concluded instead that the unpaid refunds should be paid to the State under the unclaimed property law (Civil Code Section 1500, et seq.). This case became of some significance in a number of Commission enforcement actions in which an effort was made to provide reparations to past telephone subscribers.
